TERMS OF SERVICE

ACCEPTANCE OF TERMS

By downloading, installing, accessing, or using the Martı Simulator application ("Game", "App", "Licensed Application"), you agree to be bound by these Terms of Service and End-User License Agreement ("Terms", "EULA", "Agreement"). If you do not agree to these terms, do not download, install, or use the application.

ACKNOWLEDGMENT

You acknowledge and agree that:

• This Agreement is concluded between you and Martı Simulator only, and not with Apple.
• Martı Simulator, not Apple, is solely responsible for the Licensed Application and its content.
• Apple has no obligation to furnish any maintenance and support services with respect to the Licensed Application.
• Apple is not responsible for addressing any claims by you or any third party relating to the Licensed Application.
• Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and will have the right to enforce this Agreement against you.

LICENSE GRANT

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Martı Simulator on Apple-branded devices that you own or control, solely for your personal, non-commercial entertainment purposes.

This license does NOT permit you to:

• Modify, adapt, translate, reverse engineer, decompile, or disassemble the Game
• Create derivative works based on the Game
• Copy, distribute, or make the Game available over a network
• Sell, rent, lease, sublicense, or otherwise transfer the Game
• Use the Game for any commercial purpose
• Remove, alter, or obscure any copyright or proprietary notices
• Use cheats, exploits, automation software, bots, or unauthorized third-party tools
• Interfere with or disrupt the Game's servers or networks

AGE RESTRICTIONS

Martı Simulator is designed for users of all ages. However:

• Users under 18 should review these Terms with a parent or guardian
• In-app purchases require authorization from the account holder
• Parents can enable restrictions through Apple's Screen Time parental controls
• By using the Game, you represent that you have the legal capacity to enter into this Agreement, or have obtained parental/guardian consent

USER CONDUCT

When using Martı Simulator, you agree to:

• Use the Game only for lawful purposes
• Respect the gaming experience of other players
• Not exploit bugs or glitches for unfair advantage
• Report any security vulnerabilities responsibly
• Comply with all applicable laws and regulations

IN-APP PURCHASES

Martı Simulator offers optional in-app purchases ("IAP"). The only real-money purchase is the one-time "Remove Ads" product. By making a purchase:

• All transactions are processed through Apple's App Store
• You agree to Apple's App Store Terms of Service
• Purchases are final and non-refundable (per Apple's policies)
• Virtual items have no real-world monetary value and cannot be exchanged or transferred
• We reserve the right to change the availability or pricing of in-app purchases
• Lost game data (including purchased items) due to device changes may not be recoverable

ADVERTISING

Martı Simulator contains advertisements served by Google AdMob:

• Banner Ads: Displayed on the game over screen
• Interstitial Ads: Shown after every 3 games (starting after the first 5 games)
• Rewarded Video Ads: Optional ads that can be watched to earn in-game rewards (coins, revives, etc.). You can watch a maximum of 5 rewarded ads per day.

If you grant App Tracking Transparency (ATT) permission, ads will be personalized based on your interests. If you decline, you will see contextual (non-personalized) ads.

For users in the European Economic Area, a GDPR-compliant ad consent form is displayed through the Google UMP SDK.

REFUND POLICY

All in-app purchases are processed by Apple through the App Store. Refund requests must be submitted directly to Apple:

1. Visit reportaproblem.apple.com
2. Sign in with your Apple ID
3. Select the purchase and request a refund

Apple makes refund decisions at their sole discretion. Martı Simulator does not process refunds directly. If the Licensed Application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you.

INTELLECTUAL PROPERTY

All content in Martı Simulator, including but not limited to graphics, artwork, animations, sounds, music, characters, storylines, code, and user interface elements, are owned by Martı Simulator and protected by copyright, trademark, and other intellectual property laws. All rights reserved.

The "Martı Simulator" name, logo, and associated branding are trademarks of Martı Simulator. You may not use these marks without prior written permission.

User feedback, suggestions, or ideas submitted to us may be used by Martı Simulator without compensation or attribution.

MAINTENANCE AND SUPPORT

Martı Simulator is solely responsible for providing maintenance and support services for the Game, as specified in this Agreement or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Licensed Application.

WARRANTY DISCLAIMER

Martı Simulator is provided "AS IS" and "AS AVAILABLE" without warranty of any kind. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application.

DISCLAIMER

We do not guarantee or warrant:

• That the Game will be error-free, uninterrupted, or secure
• That defects will be corrected
• That the Game will meet your specific requirements
• The accuracy or reliability of any information obtained through the Game
• The preservation of game data, scores, or achievements
• Compatibility with future device or operating system updates

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Martı Simulator and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Game
• Any conduct or content of any third party in the Game
• Any content obtained from the Game
• Unauthorized access, use, or alteration of your transmissions or content
• Loss of game progress, virtual items, or in-app purchases

PRODUCT LIABILITY & CLAIMS

Martı Simulator, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and use of the Licensed Application, including but not limited to:

• Product liability claims
• Any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement
• Claims arising under consumer protection, privacy, or similar legislation

INTELLECTUAL PROPERTY CLAIMS

Martı Simulator, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights.

TERMINATION

This Agreement is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any of its terms.

We may terminate or suspend your access to the Game immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Conduct that harms other users or the Game
• Extended periods of inactivity
• Requests by law enforcement or government agencies

Upon termination:

• Your license to use the Game will immediately cease
• You must delete all copies of the Game from your devices
• Virtual items and game progress may be permanently deleted
• You will not be entitled to any refund of purchases made

DISPUTE RESOLUTION

Any dispute arising from or relating to these Terms or your use of Martı Simulator shall be resolved as follows:

Informal Resolution

Before filing any formal proceeding, you agree to try to resolve the dispute informally by contacting us at info@martisimulator.app. We will attempt to resolve the dispute within 30 days.

Mediation

If informal resolution fails, disputes may be submitted to mediation before any court proceedings.

Jurisdiction

Any legal proceedings shall be brought exclusively in the courts of Istanbul, Turkey.

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Istanbul, Turkey.

If you are accessing the Game from outside Turkey, you are responsible for compliance with local laws.

SEVERABILITY

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms, which shall remain in full force and effect.

ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Martı Simulator regarding the use of the Game and supersede all prior agreements, understandings, negotiations, and discussions, whether oral or written. No waiver of any provision of these Terms shall be effective unless in writing and signed by Martı Simulator.

CHANGES TO TERMS

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of these Terms
• Post a notice within the Game
• Update the Terms on our website

Your continued use of Martı Simulator after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Game.
